Cyber Essentials checkout terms
- You have 6 months from receiving the question set to complete certification.
- If you miss the deadline, you may need to repurchase to start again.
- Configuration changes to your devices are made by your IT team or supplier, not by Forensic Control.
1. About this agreement
This agreement is between you, the Client, and Forensic Control Limited, a company registered in England and Wales with registered office at 15 Belgrave Square, London SW1X 8PS. By ticking "I agree to the terms" on the checkout page, you agree to be bound by these terms. This version is provisional pending final Forensic Control/legal/accounting approval.
2. Services we will provide
Forensic Control will provide the Cyber Essentials package selected at checkout, including access to the IASME-licensed Cyber Essentials questionnaire, review and assessment of your completed questionnaire by an accredited assessor, support during the assessment period, and issue of your Cyber Essentials certificate on successful completion.
Where cyber insurance is referenced, eligibility is subject to the applicable scheme and insurer requirements, including organisation scope, location, turnover and other eligibility criteria.
3. Your responsibilities
You are responsible for providing accurate information, responding to assessment queries in a timely manner, making required configuration changes to your own systems, and ensuring relevant staff or suppliers are available during the assessment.
Configuration changes to your devices, operating systems, firmware, applications, policies or procedures must be implemented by you or your IT supplier. Forensic Control does not make configuration changes on client devices as part of this checkout purchase.
4. Time limits and repurchase
Cyber Essentials must be achieved within 6 months of receiving the Cyber Essentials question set. If you do not complete the assessment within this window, you may need to repurchase certification at the prevailing rate to start again.
5. Commencement and payment
This agreement commences on your acceptance of these terms and successful payment via our payment processor, Stripe. You will receive a confirmation email and access to the assessment kit within one working day of payment.
Stripe handles card data, tax calculation, VAT/tax ID records where supplied, receipts and invoices. Forensic Control does not store full card numbers. The Stripe invoice or receipt is the payment and tax record for the order.
6. Transaction evidence
When you accept these terms and place an order, we record your IP address, browser and device details, timestamp, selected package and order total. We use this information to evidence the transaction, prevent misuse, administer the service and resolve support or billing queries.
7. Tax
Stripe calculates the final tax amount before payment is completed using the billing country, billing address and any supported VAT/tax identification number provided at checkout. UK VAT may apply to UK customers. For eligible non-UK business customers, VAT treatment may differ, including reverse charge or outside-scope treatment where applicable.
8. Refunds and cancellation
As a B2B service, the Consumer Contracts Regulations 2013 do not apply. Forensic Control may issue a refund if requested in writing within 7 days of purchase, provided the assessment has not commenced and the assessment kit has not been issued. After the assessment kit has been issued or assessment work has commenced, refunds are at Forensic Control discretion. This wording is provisional pending final approval.
9. Data protection
We process your personal data in accordance with our Privacy Policy. Forensic Control is the data controller for the information you provide on this checkout page and during the assessment process. We process this information to administer the order, provide the service, evidence the transaction, handle billing/support queries and meet legal or operational obligations.
10. Limitation of liability
Forensic Control total liability under this agreement is limited to the fees paid by you for the selected Cyber Essentials package, except for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited under English law. This wording is provisional pending final approval.
11. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
